The UCC statute of limitations is four years; the relevant common law statute of limitations was ten years. All parties agreed that the cause of action accrued in 2011, so the statute of limitations would have already run if the UCC applied; not so if the common law statute of limitations was applied.
The basic elements required for the agreement to be a legally enforceable contract are: mutual assent, expressed by a valid offer and acceptance; adequate consideration; capacity; and legality. In some states, element of consideration can be satisfied by a valid substitute.
So in order for us at AAF to be able to help you we need to see the following basic documents:
1.) The Promissory Note. The evidence of the debt.
2.) The Deed of Trust ( DOT ) or Mortgage Instrument which details the terms of the loan.
3.) Any Assignments of the Note. In other words evidence the note has changed hands since you signed it.
